Explanation

The Rodney District Council has received a request for a Private Plan Change to the Rodney District Proposed District Plan 2000 – Operative in Part (the proposal): The Council has considered the request and concluded that it met the tests to proceed to the stage of public notification.

The proposal is a private proposal and not a Council one and in terms of the Resource Management Act, the proposed Plan Change has no legal effect until the Plan Change is made operative. The Council is not required to support or oppose the Plan Change at this stage but simply to publicly notify it. The Council’s opportunity to support or oppose the proposal comes through its right to make a submission on the proposal and through its decision making function under the Act.

Perrendale Holdings Ltd has lodged a Private Plan Change request to Chapter 14 – Scheduled Activities (operative) of the Rodney District Plan for the land at the Stockyard Falls Retail Centre on Woodcocks Road/Mansel Drive, Warkworth (Lot 1 DP 386584).

The request is to include provision for limited light industrial activities currently specifically excluded from the planning provisions under Scheduled Activity 328 (shops and other commercial activities) relating to this site. The proposal would result in shops and commercial activities of a total Gross Leasable Area of approximately 25,275m² to 30,500m2 being able to be established subject to approval to specific resource consent applications.

The proposal includes an indicative development plan that envisages 11 retail stores, 1 trade retail store, 1 department/variety store, 3 concessionaire stores, 2 buildings for personal and business service activities, 5 prepared food outlets, 1 education/childcare centre and 3-5 light industrial buildings.

The proposal may be inspected at Council’s offices at 50 Centreway Road, Orewa, Baxter Street, Warkworth; State Highway 16, Huapai; and Commercial Road, Helensville, and all Rodney District Council Public libraries; at any time when the above places are open to the public, as well as on Council’s website www.rodney.govt.nz

Any person may make a submission on the proposal. You may do so by sending a written submission to: Rodney District Council, Private Bag 500, OREWA, Attention: Environmental Policy and Planning. The submission must be on Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Council offices listed above and on Council’s website under District Plan 2000 Variations and Plan Changes.

Submissions close on Wednesday 11 August 2010.

The process for public participation in the consideration of the proposal under the Act is as follows:

  • After the closing date for submission, Rodney District Council must prepare a summary of the decisions requested in submissions and this summary must be publicly notified
  • There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made
  • If a person making a submission asks to be heard in support of his or her submission, a hearing must be held
  • Rodney District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions)
  • Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
