Proposed Plan Change/Variation 123 - Introduction of Special 26 and Special 25 Zones

Public Notice of Proposed Plan Change/Variation 123 to The Rodney District Proposed District Plan 2000 –  Introduction of Special 26 (Hibiscus Coast Gateway Recreation and Entertainment) Zone and Special 25 (Hibiscus Coast Gateway Specialist Retail) Zone and other amendments

Note: This notice should be read in conjunction with the Public Notice by the ARC of Proposed Plan Change 15 to the Auckland Regional Policy Statement to shift the Metropolitan Urban Limit.

The Rodney District Council has prepared the above Plan Change/Variation to the Rodney District Proposed District Plan 2000.

Explanation

The proposed Plan Change/Variation introduces the Special 26 (Hibiscus Coast Gateway Recreation and Entertainment) Zone in the Rodney Proposed District Plan 2000 (the District Plan).

The Plan Change/Variation applies to the land between East Coast Rd, the Hibiscus Coast Highway, the Motorway (SH1), and the southern boundary of the “Snow Planet” site. The land is mostly in pasture but parts of it are used for recreation activities, including the Go-cart track, the Luge and the Snow Planet, and for retail activities (Kings Plant Barn and associated shops).

The Hibiscus Coast Gateway Recreation and Entertainment Zone provides for the development and operation of recreation and entertainment activities. The rules also allow only a minor range of other ancillary activities such as restaurants, cafes and small shops associated with the recreation activities. Provision is also made for a Park and Ride facility.

The Plan Change/Variation also introduces the Hibiscus Coast Specialist Retail Zone (Special Zone 25) which applies to the land occupied by the Kings Plant Barn and a number of other retail activities. The zone provisions enable the existing activities to remain on the site.

The Variation may be inspected at Council’s offices at 50 Centreway Road, Orewa, Baxter Street, Warkworth; State Highway 16, Huapai; and Commercial Road, Helensville, and all Rodney District Council Public libraries; at any time when the above places are open to the public, as well as on Council’s website under ‘Planning and Development’, ‘District Plan 2000 Variations’. Any person may make a submission on the proposal. You may do so by sending a written submission to: Rodney District Council, Private Bag 500, OREWA, Attention: Environmental Policy and Planning. The submission must be on Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Council offices listed above and on Council’s website.

Submissions close on Friday 23 July 2010

The process for public participation in the consideration of the proposal under the Act is as follows:

• After the closing date for submission, Rodney District Council must prepare a summary of the decisions requested in submissions and this summary must be publicly notified
• There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made
• If a person making a submission asks to be heard in support of his or her submission, a hearing must be held
• Rodney District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions)
• Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
