Public Notice of Proposed Variation 141 To The Rodney District Plan 2000 – Operative In Part – Blacked Out Provisions
The Rodney District Council has prepared the above Variation to the Rodney District Plan 2000 – Operative in Part (the proposal):
Explanation
A summary explaining Variation 141 is included in the Council's media release.
Variation/Plan Change 141 has been prepared to indicate the Council’s intention to amend the rules in Chapter 22 of the Rodney District Plan 2000. This would change the activity status of certain blacked out activities in Chapters 7, 8, 9, and 13 of the plan. The changes will only affect the activity status of:
- Subdivision within the Countryside Living Rural and Town zones
- Cluster housing within the residential zones
- Subdivision within the Low Intensity Residential zone
- Site sizes for minor household units in the Low Intensity Residential zone
- Activities in the Orewa Town Centre Policy Area.
For most of the above zones the variation will have little or no affect on properties within the zone. The variation will simply mean that any of the activities which are blacked out in the District Plan will no longer be Non-Complying activities. The black shading will be removed and the activities will revert to the activity status as stated within the relevant chapter.
The exception to this is in the Residential Low Intensity zone and the Residential Landscape Protection zones, where the alternative minimum site size of 8000m² will be retained in the policies and rules as set out in the variation document.
The proposal may be inspected at Council’s offices at 50 Centreway Road; Orewa, Baxter Street, Warkworth; State Highway 16, Huapai; Commercial Road, Helensville, and all Rodney District Council Public libraries; at any time when the above places are open to the public, as well as on the Council’s website. Any person may make a submission on the proposal. You may do so by sending a written submission to: Rodney District Council, Private Bag 500, OREWA, Attn: Environmental Policy and Planning. The submission must be on Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Council offices listed above and on the Council’s website.
Submissions close on Friday 7 May 2010.
The process for public participation in the consideration of the proposal under the Act is as follows:
- After the closing date for submission, Rodney District Council must prepare a summary of the decisions requested in submissions and this summary must be publicly notified, and
- There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
- If a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
- Rodney District Council must give its decision on the proposal
(including its reasons for accepting or rejecting submissions); and
- Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
