Public Notice Of Proposed Variation 134 to The Rodney District Plan 2000 – Operative In Part – Waimauku Rezonings and Notations

The Rodney District Council has prepared the above Variation to the Rodney District Plan 2000 – Operative in Part (the proposal):

Explanation

The purpose of this Variation is to implement parts of the Waimauku Structure Plan. The Structure Plan was adopted in May 2009 and represents a clear direction for the future of the township. This Variation now implements some of the Structure Plan into zonings, notations and rules in the District Plan.

The Variation rezones the area of existing Future Urban zoned land in Waimauku to a ‘live’ Residential zone (with site specific rules through a Restricted Activity). Indicative walkways are also shown in this area. The Variation also rezones a small area of land in the northwest of the township to Industrial to reflect its current use. A Restricted Activity is also used on this land to limit the possible sprawl of retail activities along SH16.

The Variation also introduces a backdrop protection area on land known as “Renall’s Hill”, and protection for a row of trees along the Muriwai Road near the entrance to Waimauku. The Variation also adds 17 heritage items to the schedules in the District Plan in order to protect these items.

The proposal may be inspected at Council’s offices at 50 Centreway Road; Orewa, Baxter Street, Warkworth; State Highway 16, Huapai; Commercial Road, Helensville, and all Rodney District Council Public libraries; at any time when the above places are open to the public, as well as on the Council’s website.

Any person may make a submission on the proposal. You may do so by sending a written submission to: Rodney District Council, Private Bag 500, OREWA, Attention: Environmental Policy and Planning. The submission must be on Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Council offices listed above and on Council’s website.

Submissions close on Friday 30 July 2010.

The process for public participation in the consideration of the proposal under the Act is as follows:

• After the closing date for submission, Rodney District Council must prepare a summary of the decisions requested in submissions and this summary must be publicly notified
• There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made
• If a person making a submission asks to be heard in support of his or her submission, a hearing must be held
• Rodney District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions)
• Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
