Public Notice Of Proposed Variation 144 To The Rodney District Proposed District Plan 2000 – Introduction of Helensville Town Centre Heritage Policy Area and Other Changes

Explanation: This proposed variation puts in place a number of recommendations of the Helensville Urban Design Framework and the other studies. The proposed variation includes the following changes:

• Changes to the objectives and policies of Chapter 9 – Business that recognise the distinct heritage character of parts of the Helensville Town Centre area
• Provision of the Helensville Town Centre Heritage Policy Area within Chapter 9 – Business. The Policy Area includes specific rules and assessment criteria for the erection of new buildings and the alterations and additions to and removal of some existing buildings within the policy area
• The addition of a number of significant trees to the list of scheduled protected trees in Chapter 18 – Urban Land Modification and Vegetation
• The provision of a new Policy and a Restricted Activity that discourages retail and other community focused activities in the Helensville Industrial Zones and a Restricted Activity that provides for larger shops in the southern Commercial Road Area
• Changes to the zoning of some properties in the southern part of Commercial Road
• Relaxation of parking provisions in parts of the Helensville Town Centre Heritage Policy Area where car parking requirements can affect the viability of providing buildings that complement the heritage values in the Policy Area.

The proposal may be inspected at Council’s offices at 50 Centreway Road, Orewa, Baxter Street, Warkworth; State Highway 16, Huapai; and Commercial Road, Helensville, and all Rodney District Council Public libraries; at any time when the above places are open to the public, as well as on Council’s website.

Any person may make a submission on the proposal. You may do so by sending a written submission to: Rodney District Council, Private Bag 500, Orewa, Attn: Environmental Policy and Planning. The submission must be on Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Council offices listed above and on Council’s website

Submissions close on Friday 16 July 2010.

The process for public participation in the consideration of the proposal under the Act is as follows:

• After the closing date for submission, Rodney District Council must prepare a summary of the decisions requested in submissions and this summary must be publicly notified
• There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made
• If a person making a submission asks to be heard in support of his or her submission, a hearing must be held
• Rodney District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions)
• Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
