Public Notice of Proposed Variation 133 to the Rodney District Plan 2000 Operative In Part – Warkworth Countryside Living

The Rodney District Council has prepared the above Variation to the Rodney District Plan 2000 – Operative in Part.


Explanation
The proposed Variation seeks to implement the findings of the adopted Warkworth Structure Plan by introducing new rules and assessment criteria specific to the Countryside Living Town zone in Warkworth, and by rezoning an area to Countryside Living Town, in order to align with the adopted Structure Plan.

The Warkworth Structure Plan specifies that a review of the Countryside Living Town rules is required to ensure the subdivision and rules for single household units adequately provide protection of the ridgelines, landscapes and landforms that contribute to Warkworth’s character. This Variation amends the appropriate rules to achieve this.

The Variation also proposes to rezone an area of land on Falls Road/Viv Davie Martin Drive from General Rural to Countryside Living Town. The subdivision of this area of land to a Countryside Living Town density was previously approved by Consent Order through the Environment Court and the land has largely been developed in this manner as a result. The rezoning simply recognises that the land is already developed to the site size expected in a Countryside Living Zone.

The proposals may be inspected at Council’s offices at 50 Centreway Road, Orewa, Baxter Street, Warkworth; State Highway 16, Huapai; and Commercial Road, Helensville, and all Rodney District Council Public libraries; at any time when the above places are open to the public, as well as on Council’s website.

Any person may make a submission on the proposals. You may do so by sending a written submission to:

The submission must be on Form 5 and must state whether or not
you wish to be heard on your submission. Copies of this form are available from the Council offices listed above and on the website.

Submissions close on Friday 12 February 2010.

The process for public participation in the consideration of the proposal under the Act is as follows:

  • After the closing date for submission, Rodney District Council must prepare a summary of the submissions and this summary must be publicly notified, and
  • There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
  • If a person making a submission asks to be heard in support of his or her submission, a hearing must be
    held; and
  • Rodney District Council must give its decision on the proposal (including its reasons for accepting or
    rejecting submissions); and
  • Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
