Swimming Pool Regulations

All new swimming pools (including spa pools) and associated fencing requires a building consent prior to installation.   The swimming pool and fencing need to comply with both the building code and the Fencing and Swimming Pool Act 1987.

The Council is responsible for issuing building consents and implementing the Fencing of Swimming Pool Act 1987 if you are the owner or the occupier of a property that has a pool you are responsible for ensuring that the fencing complies with the Act.

If you have an existing swimming pool you are required to notify the Council and have it registered with the Council. At all times your pool fencing and doors leading to the pool must comply with the Act. There are some exemptions which require specific approval from Council. 

What is a Swimming Pool?

Any excavation, structure or product that is or can be used for swimming, wading, paddling, or bathing – including spa pools, with a depth of water over 400mm, are covered by the building code and the Act.

What am I required to do?

If you have a pool you can obtain a copy of the Act from the Council office and if you have any questions contact the Council and ask to speak to a Compliance Officer.

Council will maintain a record of your pool on the Swimming Pool Register. Council will inspect your pool from time to time and advise you of any areas of non-compliance.  Both the first and scheduled inspection will be charged to you.

If your pool does not comply you should empty it of water immediately until it fully complies. It is also important to remember that your pool fencing (if your pool has water in it) must comply with the Act and building code at all times.
