What is a LIM?

A Land Information Memorandum is a report issued by Council which provides information on a property within the Council District.

The information provided is limited to information that the council holds, and which is not available from the District Plan. It can include any or all of the following:-

  • Certificate of Title
  •  A 7 Mapset showing the location, reticulation, geological information, expansive soils information, inundation potential, flood plains and significant natural areas.
  • Asbuilt drainage plans
  • Details of any Resource Consents
  • Land Rates and Water Rates (if applicable)
  • Water Connection Loan status (if applicable)
  • Building Consents
  • Building Permits
  • Unauthorised Works
  • Notices to Fix
  • Building Condition Report
  • Building Warrant of Fitness - Compliance Schedules
  •  Abatement Notices
  • Land Zoning
  • Structure Plan details
  • Recorded Swimming Pools
  • Special Features Affecting the Land
  • Geotechnical/Site Reports
  • Bush Protection
  • Health and Licensing Condition
  • Health Requisitions

 
Please note that the information supplied in a LIM is only valid at the date that the LIM is issued. Changes to the status of a property may occur after a LIM is issued.

What you won't get in a LIM?

  • Any information held by the Council not directly related to the piece of land or building on that land as described by the legal description.
  • Floor plans and specifications of any buildings, however we can provide these as part of a Building Records Search.
  • Copies of reports the council holds relating to soil and land characteristics. These can be requested as part of a Land Development Information Enquiry.

Why get a LIM?

If you are considering purchasing a property in Rodney district you may wish to obtain a LIM before finalising the purchase. A LIM may assist you in determining if a property has any restrictions or whether your intended use of the land is feasible. You do not need a sale and purchase agreement to obtain a LIM - anyone can request a LIM.

How do I request a LIM?

Anyone can request a LIM. You do not need a sale and purchase agreement as is sometimes thought. Complete the application form and return to any of the Council offices along with payment. Please note that you will also need to supply:

 - the street address of the property you want a LIM on
 - the legal description of the property and area size
 - it also helps us if you can provide the name of the current owner

Application forms are available at each of the Council offices for collection and may also be posted, faxed or emailed, alternatively you can download an application form here.

Please note that a LIM request will not be actioned until actual payment has been received. The cost of a LIM effective 1st July 2009 is $200 (GST inclusive) per property rate account. 

RDC reserve the right to amend charges for multiple or complex requests.

Please include full payment with your application. Payment must be made at the time you lodge your application. The Council accepts cash, cheque, EFTPOS , credit card (for payments under $500). Note: credit card payments must be paid in person at a Service Centre and not over the phone.

You can also pay via
Internet Banking but must quote the address of the property and 'LIM' in the reference field.

How long does it take to get a LIM?

We endeavor to complete and deliver all LIMs as quickly as possible, however you should allow the maximum statutory time frame of 10 working days for a LIM.

We consider all LIMs urgent and under normal workloads usually deliver in 6 - 7 working days.

Please note the LIM fee is non refundable should a cancellation be requested.

Copies of a LIM

The Council will only provide copies of LIMs, provided the following criteria are met:

 - The original request is no older than 4 months and

 - Only the original applicant may request a copy of a LIM and

 - Cost will be $20.00 for the copy.
