Bylaws

A bylaw is a local rule or regulation made by the Council which affects the community.  The consequences of not complying with a rule range from fines, seizure of property and remedial action.

New bylaws must be reviewed within five years of confirmation, others within 10 years from the last review.  The Council may amend, introduce or revoke a bylaw at any time using the process prescribed in the Local Government Act 2002.

Rodney District Council Bylaws

Chapter 1 - Bylaw Administration (PDF 121kb)
This bylaw sets out the general powers of the Council and provisions which apply to all chapters.  It also contains definitions and sets out provisions relating to licenses, fees, dispensations, breaches, penalties and offences.

This bylaw relates to the prevention and spreading of fires in the open air within Urban Fire Districts.

This bylaw ensures the effective and efficient operation of the Marina, to ensure the health and safety of marina users and the public and to prevent nuisance and annoyance to surrounding residents.

This bylaw sets out a licensing regime to ensure that any proposal for trading in public places is fully evaluated and that only suitable proposals are approved.

This bylaw provides the means for the Council to act in regulating the movement and tethering of stock on roads.

This bylaw regulates the behaviour and use of public places, roads and reserves under the control of the Council.

Chapter 9 - Road Crossings and Numbering of Premises (PDF 21kb)
This bylaw protects the road asset by setting rules for public crossings across roads and water channels and enables the Council to name  roads and indentify premises to facilitate the work of emergency services, postal authorities and others.

This bylaw promotes, protects and maintains public health in travellers accommodation and public buildings.

Chapter 11 - Water Supply (PDF 64kb)
The bylaw makes clear that the terms and conditions of the water service supplied and received, including fees and charges payable, are set out in the completed Council application form and constitute a contract between the parties.

Chapter 12 - Use of Public Wharves and Boat Ramps (PDF 47kb)
This bylaw relates to the regulation of activities on all wharves and boat ramos in Rodney, which are owned and operated by the Council.

Chapter 13 - Building Deposits for Damage to Council Property  PDF 34kb
This bylaw enables the Council to recover the cost of any unrepaired damage to Council property arising as a consequence of building work authorised by a building consent.  It also prohibits any illegal connection to, or interference with Council infrastructure.

The purpose of this bylaw is to introduce control measures to manage the potential impact of brothels, small owner-operated brothels and commercial sex premises on sensitive activities.

This bylaw is the sole means by which all permanent road speed limits on public roads, including beaches, under the control of the Council are set or altered.

The purpose of this bylaw is to provide controls for temporary signs within Rodney.  
If you require a temporary sign or a dispensation for a temporary sign you would need to complete and return the appropriate application forms.

Permanent signs are managed through the District Plan.
