What is a District Plan?

The District Plan is a document prepared in accordance with the provisions of the Resource Management Act 1991. It consists of maps, objectives, policies and rules, which set out the activities permitted in the Rodney District. It also determines where resource consents and subdivision consents are required, and under which conditions these can be approved.

History

In 1989 Rodney District Council was formed by the amalgamation of the Borough of Helensville and Rodney District. Each of these former Councils had their own District Plan. Collectively, these plans are known as the "Transitional Plan". This Plan now also includes Plan Change 26 on the Residential Section and Plan Change 55 affecting the Rural Section.

In November 2000 the Rodney District Council released its Proposed District Plan which was publicly notified. This Plan covers the entire Rodney District. It consists of a map book and two volumes of text.

The Proposed District Plan is a review of the operative Rodney District Plan. It encompasses matters addressed in Plan Changes not yet made operative. Any person who owns land or wishes to develop land within the District may be affected by the Proposed Plan.
 

Proposed Plan versus Operative Plan

The Proposed Plan has legal effect from the date of notification.

The existing Operative Transitional Plan continues to have legal effect until the Proposed Plan becomes fully operative. This will happen once all submissions and appeals have been settled. In the interim it is necessary to comply with both the Operative and the Proposed Plan with the following exceptions:

(i)         a rule in the Operative Plan that is inoperative pursuant to section 19 of the RMA;
(ii)        a proposed plan rule that the Council has resolved not to give effect to until the Proposed Plan becomes operative.

Otherwise both plans must be referred to when establishing if a resource consent is required.

Section 19 of the Resource Management Act 1991 provides the circumstances when a new rule can be treated as if it is operative. If no submissions in opposition or appeals have been lodged, or all submissions in opposition and appeals have been determined, or withdrawn or dismissed, the rule becomes operative and any previous rule is inoperative.
 

What stage is the Proposed District Plan at?

The District Plan Committee has completed the hearing of submissions (Refer to Proposed District Plan 2000 - Summary of Submissions & Further Submissions) to the Proposed District Plan 2000 and has released its decisions on submissions. The decisions can be viewed on the Decision Notices page.  The Proposed District Plan  has now been updated to incorporate decisions and appeals that have been resolved.

Council is working with the appellants and the Environment Court to resolve the issues raised in the appeals.  Any inquiries relating to the current status of any of the appeals should be directed initially to Sue Healy on 0800 426 5169 (426 5169 for HBC residents).


Copies of the District Plan

Copies of the Operative Transitional Plan and the Proposed District Plan are available for inspection at any of the Council offices or public libraries. Copies have also been distributed to:

  • libraries in North Shore City and in Henderson.
  • the Waitakere City Council.
  • the ARC headquarters in Hopetoun Street, Auckland.

Alternatively, the Proposed District Plan or Operative District Plan are available online.
