Thermal Energy Generation Rural Zone - Plan Changes/Variations to Rodney District Plans


The Rodney District Council has received a request for a Private Plan Change to the Operative Rodney District Plan 1993 and a parallel Variation to the Proposed Rodney District Plan. The Council considers the request has met the tests to enable it to proceed to public notification.

Explanation

The proposed change is a private plan change initiated at the request of Genesis Energy Ltd under Section 73 of the Resource Management Act 1991. Also publicly notified is a parallel Variation to the Proposed District Plan 2000 with specific provisions ensuring the Variation has no effect before this plan change is made operative.

Section 73 of the Resource Management Act 1991 allows any person to request a plan change to the Operative District Plan. Provided that adequate information on the environmental effects of any change is supplied and amongst other things, that the proposal is not frivolous or vexatious and is not contrary to sound Resource Management practice, the Council is obliged to publicly notify the request. In this case, the Council considered the proposal met the conditions and has proceeded to publicly notify the proposal.

The proposal is a private proposal and not a Council one and in terms of the Resource Management Act, the proposed plan change has no legal effect until it is made operative.

The Council is not required to support or oppose the plan change (and related Variation) at this stage, but simply to publicly notify it. Council’s opportunity to support or oppose the proposal comes through its right to make a submission on the proposal during the submission period, and/or through its function as the body which is required to make decisions on all submissions.

Proposed Plan Change 107 and corresponding Proposed Variation 89 introduces a new Special Zone, the Rodney District Thermal Energy Generation Rural Zone, in the vicinity of SH16 and Inland Road (Punganui Station), between Helensville and Kaukapakapa. The new zone would enable the area of land within the zone to be developed for the purpose of the generation and transmission of electricity and in particular the development and operation of a Rodney Power Station.


Rodney Power Station

Genesis Energy is proposing to establish a new combined cycle gas turbine power station (“Rodney Power Station”) to the south of SH16, adjacent to the intersection of SH16 and Inland Road. 
 

Background information

At a meeting on 31st January 2008 Council resolved to:

  • accept the Genesis Energy request for a private plan change and notify this;

  • accept the request to promulgate a variation to the proposed District Plan 2000;

  • engage independent commissioners to hear submissions to the plan change and variation;

  • allow the hearing of submissions to the plan change and variation to be heard together with the ARC resource consent submissions;

  • provide advice to the community on the hearings processes to be conducted by the ARC and RDC.

Submissions

Any person may make a submission on Proposed Plan Change 107 and/or corresponding Proposed Variation 89.

The submission must be on Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Council offices listed below or you can download a submission form.

The written submission must be forwarded to:

What happens next?

After the closing date for further submissions on the 23 July 2008 , a report will be prepared and hearings will be held; and Rodney District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.  The hearing of submissions is scheduled to commence on 24 September 2008.
